If the planning director, based upon an annual inspection or otherwise confirmed by an inspection of the surface mining operation, determines that it is not in compliance with this chapter, the approved conditional use permit or reclamation plan, the city shall follow the procedures set forth in SMARA concerning violations and penalties, as well as those provisions of Chapter 17.64 of this code concerning revocation of the conditional use permit which are not preempted by SMARA.
