A. It shall be the duty of the director of prevention services, or designee, to enforce the provisions of this chapter.

B. Any structure erected or maintained, or any use of property, contrary to the provisions of this chapter shall be, and the same is, unlawful and a public nuisance, and the director of prevention services, or designee, in conjunction with the city attorney shall immediately commence actions and proceedings for the abatement, removal and enjoinment thereof in the manner provided by law. Violators will be liable for all enforcement costs incurred by the city.

C. This chapter may also be enforced by injunction issued out of Superior Court upon suit of the city, or the owner or occupant of any real property affected by such violation.

D. Permits issued in conflict with the provisions of this chapter shall be null and void. (Ord. 4058 § 2, 2002; Ord. 3477 § 1, 1992)
