A. The board of appeals for handicapped access shall hear written appeals brought by any person regarding action taken by the building department of the city in enforcement of the requirements of Part 5.5 of Division 13 (Sections 19955 through 19959) of the California Health and Safety Code.

B. The board shall conduct hearings on written appeals made under subsection A, above, and may approve or disapprove interpretations of the specified Health and Safety Code sections and enforcement actions taken by the building department of the city. All such approvals or disapprovals shall be final and conclusive as to the building department in the absence of fraud or prejudicial abuse of discretion.

C. The board shall adopt reasonable rules and regulations, consistent with the purposes of the Health and Safety Code and provisions of this chapter for conducting its hearings.

D. The planning director and the building director shall serve in an advisory capacity to the board on all matters which may come before it. (Ord. 3287 § 1, 1990)
