As a condition of approval of a tentative map, the subdivider shall do the following:

A. Dedicate or make an irrevocable offer of dedication of all land within the subdivision that is needed for public streets, alleys, including access rights and abutters’ rights, drainage, public utility easements and other public easements.

B. Record a covenant that is approved by the city attorney and city water manager that, among other items, each lot prohibits the pumping and taking of groundwater from the property for any use off the property; provided, however, such pumping and taking may be carried out by the authorized urban water purveyor which provides water service to the subdivided land, or by a county-wide governmental entity with water banking powers, and such pumping is part of an adopted water banking program that will not have a significant adverse impact on the groundwater levels or diminish the quality of water underlying the subdivision.
