Only the public works director/city engineer, or authorized designee, is granted the authority to provide for modifications of the requirements set forth in this chapter. Where there are practical difficulties involved in carrying out the provisions of the standards and specifications set forth in this chapter, the public works director/city engineer, or authorized designee, may grant modifications for individual cases. The public works director/city engineer, or authorized designee, shall first find that a special individual reason makes the strict letter of these standards and specifications impractical and that the modification is in conformance with the intent and purpose of these standards and specifications and that such modification does not lessen any public safety requirement. The details of any action granting any modification shall be recorded and entered in the files of the public works department. Any determination of the public works director/city engineer, or authorized designee, pertaining to the interpretation and application of this chapter shall be final and conclusive.
