Any person, firm or corporation failing to remove any encroachment from any property of the city, or from any street, avenue, lane, alley, sidewalk, court, place, public way, property or rights-of-way, now open or dedicated or which may hereafter be opened or dedicated to public use within the city, within the time specified in the notice for removal by the city engineer, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not to exceed three hundred dollars, or by imprisonment in the County Jail for a period of not to exceed ninety days or by both such fine and imprisonment. Each day during which such encroachment is maintained after the date specified for removal shall constitute a separate offense. (Ord. 3140 § 1, 1988; prior code § 12.32.040)
