The exercise by any person, firm or corporation of any privilege for which a franchise is required without first procuring a franchise, shall be a misdemeanor, punishable by a fine of not more than Five Hundred Dollars or by imprisonment for not more than six months in the County Jail or by both such fine and imprisonment and each day that such violation continues shall constitute a separate offense.

In addition to the penalty prescribed above any person, firm or corporation exercising a franchise or privilege in violation of this article shall be liable to the City of Bakersfield in the amount of One Hundred Dollars for each and every day of such violation. (Amended November 3, 1964)
